The CLARITY Act, the bill meant to finally divide oversight of digital assets between the SEC and CFTC, has hit fresh turbulence. Justice Department prosecutors have floated a new round of law enforcement provisions for the legislation, and a White House crypto adviser has already dismissed the proposal as “not even close” to what the administration wants. For traders tracking the timeline toward a Senate vote, the disagreement is a reminder that the bill’s path to law is still anything but settled.

What Happened

As the Senate’s window to act on the CLARITY Act narrows, DOJ prosecutors reportedly submitted proposed language aimed at strengthening federal law enforcement authority inside the bill’s market structure framework. The specifics of that language have not been made public in full, but the pitch appears to center on giving prosecutors more direct tools to pursue fraud, market manipulation, and enforcement actions that touch digital asset markets once jurisdiction is split between regulators.

The response from inside the administration was swift and blunt. A White House crypto adviser characterized the DOJ’s proposed changes as far removed from the administration’s own position on how the bill should be structured, signaling that another round of negotiation, or outright conflict, lies ahead before any floor vote can happen. That kind of public daylight between the DOJ and the White House on a bill this close to a vote is unusual, and it suggests the disagreement runs deeper than routine legislative drafting.

This isn’t the first time an outside institutional voice has raised concerns about the bill’s enforcement architecture. New York’s Attorney General has separately warned that the CLARITY Act could weaken state-level crypto policing, arguing that a federal-first structure risks leaving gaps that state regulators currently fill. The DOJ’s push for more federal enforcement authority and the state-level pushback represent two very different worries about the same underlying question: who actually polices crypto markets once this bill becomes law.

What It Means for Traders

For active traders, the immediate takeaway is timeline risk. Every new stakeholder objection, whether from prosecutors, state regulators, or industry groups, adds friction to a bill that already has multiple moving parts to reconcile before a vote can happen. Traders should treat this as one more data point in an ongoing legislative process rather than a signal to change positioning outright. The bill’s fate still depends on how the DOJ, the White House, and Senate negotiators resolve their differences over the coming weeks.

The Bigger Picture

The DOJ-White House friction fits a broader pattern that has defined the CLARITY Act’s slow march through Congress. Momentum has ebbed and flowed throughout 2026, and market watchers have adjusted their expectations accordingly. Galaxy Digital, for instance, recently cut its odds of Senate passage to roughly 50 percent, reflecting exactly this kind of stakeholder pushback that keeps surfacing at inconvenient moments in the process.

At the same time, the administration has shown clear interest in getting a market structure bill across the finish line, framing it alongside broader crypto policy priorities. That momentum has not disappeared just because prosecutors and the White House disagree on enforcement language. It does mean, however, that supporters of the bill still have real work to do reconciling competing visions of federal versus state authority, enforcement power, and stablecoin treatment before the legislation is ready for a floor vote.

Whether this latest disagreement gets resolved quickly or becomes another prolonged sticking point will say a lot about how serious Washington is about delivering the regulatory certainty the crypto industry has been asking for. Until the DOJ and White House align on enforcement provisions, the bill’s exact shape, and its timeline, remain unsettled.
