SEC Proposes New Crypto Custody Rules for Investment Funds

The US Securities and Exchange Commission has proposed new rules that could change how investment funds hold and safeguard crypto assets. Chairman Paul Atkins framed the move as an attempt to “replace the grey of uncertainty created by custody rules crafted for a bygone era,” and for traders it is a signal that regulated crypto exposure is slowly getting a clearer rulebook. SEC crypto custody has been one of the biggest friction points keeping institutional money cautious.

What Happened

The proposal targets how funds and advisers store digital assets on behalf of clients, an area that existing custody rules were never designed to handle. Current requirements lean on the concept of a “qualified custodian,” a category built around traditional securities and cash rather than blockchain-based assets that can be self-custodied or held through specialized providers.

Atkins has tied the effort to the broader push for regulatory clarity, including work connected to the CLARITY Act. Rather than forcing crypto into frameworks written decades ago, the SEC is proposing language that acknowledges how digital-asset custody actually works. The proposal now enters a comment and review period before anything becomes final.

What It Means for Traders

Custody rules are not glamorous, but they are a gatekeeper for institutional flows. Funds that want to hold crypto need a compliant way to store it, and ambiguity has pushed many to the sidelines. Clearer custody standards lower that barrier and can widen the pool of regulated products that traders can access.

This also fits a visible pattern of the SEC reworking its crypto posture. The agency recently sent a custody rule overhaul to the White House for review and moved to modernize transfer-agent rules for onchain securities. Read together, these steps suggest a regulator trying to build durable plumbing for digital assets rather than litigate them case by case.

The Bigger Picture

For years, US crypto policy was defined more by enforcement than by clear rulemaking. The shift toward formal proposals, public comment, and updated definitions marks a different approach. The SEC has also been clarifying how it views staking, buybacks, and the Howey test, chipping away at long-standing grey areas.

None of this is finalized, and the details that emerge from the comment period will matter as much as the headline. But a regulatory environment that spells out how funds can safely custody crypto is structurally supportive of a more mature market, even if the near-term effect on prices is limited.
