Crypto market structure remains the open question for US traders, and a senior House lawmaker just made clear that agency rulemaking is no substitute for legislation. The House Financial Services chair said recent SEC and CFTC actions “fall short” of what a market structure bill would deliver, while expressing hope that Congress could pass one before its next session in 2027. For anyone trading US-listed crypto exposure, the timeline for real legal clarity just got longer.

The lawmaker argued that while regulators have taken useful steps, piecemeal agency guidance cannot replace a statute that defines how digital assets are classified and which regulator oversees what. The stated hope was to advance a comprehensive bill before the next Congress convenes in 2027.

That framing is an admission that the legislative path has slipped. A market structure law would settle the long-running question of when a token is a security versus a commodity, and which of the SEC or CFTC holds jurisdiction — gaps that current enforcement and FAQ-style guidance only paper over.

What It Means for Traders

The near-term read is that regulatory uncertainty stays priced in. Tokens whose legal status is ambiguous carry a discount for headline and delisting risk, and that discount does not clear until a statute removes the ambiguity. A slip toward 2027 means that overhang lingers through the current cycle.

It also keeps agency guidance as the main driver in the meantime. When rules arrive through SEC statements rather than law, each clarification can move markets — as we saw when SEC FAQs clarified staking, buybacks and the Howey test. Traders should expect that pattern of guidance-driven volatility to continue in the legislative vacuum.

Structure-sensitive names feel it most. Assets tied to staking, custody and exchange-traded products live or die on definitions, which is why the SEC’s custody rule overhaul heading to the White House drew close attention. Until a market structure law lands, these administrative moves remain the clearest signals available.

The Bigger Picture

This latest comment fits a familiar stop-start story. Momentum behind a comprehensive framework has repeatedly stalled, a pattern we tracked when crypto stocks slid as the CLARITY Act stalled in the Senate. Each delay pushes the industry’s hoped-for certainty further out and keeps the US a step behind jurisdictions that have already written their rulebooks.

There is a constructive angle, though. A chair publicly prioritizing legislation over enforcement signals intent, even if the calendar is unforgiving. The gap between that intent and a signed law is where traders live — and it is a gap measured now in quarters, not weeks.
